1. Acceptance of Terms
By accessing or using Tonality ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
Tonality is a music theory training platform designed to help musicians develop and strengthen their understanding of music theory through interactive exercises, sessions, and mentor feedback. The Service includes both free and paid subscription tiers.
3. User Accounts
You must create an account to access the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account. You may not use another person's account without their permission. Notify us immediately at support@tonality.app if you suspect any unauthorized use of your account.
4. Subscription and Billing
Tonality offers a Free tier and a Plus subscription at $12/month. Paid subscriptions are billed monthly in advance. You may cancel your subscription at any time; access to Plus features will continue until the end of the current billing period. All fees are non-refundable except where required by applicable law. We reserve the right to change subscription pricing with 30 days' notice.
5. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not attempt to gain unauthorized access to any part of the Service, interfere with or disrupt the integrity or performance of the Service, reverse-engineer or attempt to extract the source code of the Service, use automated tools to scrape or interact with the Service without our prior written consent, or use the Service to transmit any unlawful, harmful, or objectionable content.
6. Intellectual Property
The Service and its original content, features, and functionality are owned by Tonality and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service or its content without our express written permission. Your account data and progress belong to you; we claim no ownership over content you create or submit.
7. Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Mentor feedback is generated for educational purposes and does not constitute professional music instruction. Results from using the Service will vary based on individual effort and prior experience.
8. Limitation of Liability
To the fullest extent permitted by law, Tonality shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim.
9. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
